Following is the ZONING BOARD of APPEALS Agenda for 1PM, October 13, 1999. Zoning Board of Appeals meetings are held at Maloof Auditorium, 1300 Commerce Drive, Decatur.


DEFERRED HEARING ITEMS

D1. COMMISSION DISTRICT(S) 4&7

Application of Chuck Sanford, for a variance from Section 27-602 of the DeKalb County Zoning Ordinance relating to the C-2 (General Commercial) District to maintain the existing buffer and not be required to extend the buffer an additional fifty (50) feet. The project site is located between Covington Highway and Old Covington Highway, west of the Interstate Highway 20 and Turner Hill intersection.

Application of Ashton Woods Homes for a Special Exception from Section 14-39 of the DeKalb County Tree Ordinance. The project site is located on the north and south side of Mason Mill Road, east of Clairmont Road.

2. Commission Districts: 3 & 7

Application of Allan Reid for a variance from Section 27-731(C) of the DeKalb County Zoning Ordinance relating to accessory buildings to reduce the required side yard setback from ten (10) feet to five (5) feet to maintain an existing tool and storage shed. The property site is located on the north side of Tyler Way, approximately 150 feet east of Fontaine Circle.

3. Commission Districts: 1 & 6

Application of Bobbie Justice for appeal of administrative decision by the Public Works Department relating to Building Permit #99B05681. The project site is located on the east side of Gloucester Drive, approximately 357 feet south of Ramah Lake.

Application of Greystone Builders for a variance from Section 27-228(D) of the former DeKalb County Zoning Ordinance relating to the RCH (Single Family Cluster Residential) District to reduce the required rear yard setback from forty (40) feet to nineteen (19) feet to legalize an existing home constructed on site. The project she is located at the western terminus of Palmer Road, approximately 1,135 feet west of Palmer Trail.

Application of Corri Rene for a variance from Section 27-186(E) of the DeKalb County Zoning Ordinance nance relating to the R-75 (Single Family Residential) District to reduce the required rear yard setback from forty (40) feet to twenty (20) feet to construct a single family residence. The project site is located on the east side of Dickson Street approximately 465 feet south of Windsor Parkway.

Application of Now Covenant Christian Ministries for a variance from Section 27-768(C) of the DoKalb County Zoning Ordinance requirements to allow a proposed place of worship to be bested on a collector street within the R-100 district The project site is located on the west side of Philips Road, approximately 599 feet south of South Deshon Road.

Application of Mark Reimer for a variance from Section 27-731(C) of the DeKalb County Zoning Ordinance for accessory buildings related Ing to the R-75 (Single Family Residential) District to reduce the side and rear yard setback from ten (10) fast to three (3) feel to construct a two-car garage on an existing concrete slab.

Application of Patterson & Smith for a variance from Section 27-621(C)(2) relating to the M (Industrial) District of the DeKalb County Zoning Ordinance to reduce the required rear yard setback from thirty (30) feet to twenty (20) feet to construct an 18,000 square foot addition onto an existing two-story industrial building. The project site is located on the north side of Morse Drive, approximately 388 feet east of Park Central Boulevard.

Application of Brian Bowen for a variance from Section 27-166(E) of the DeKalb County Zoning Ordinance relating to the R-85 (Single Family Residential) District to reduce the required rear yard setback from forty (40) feet to twenty (20) feet to construct an attached garage two car garage. The project site is located on the east side of Oakdale Road, approximately 260 fast south of North Decatur Road.

10. Commission Districts: 1 & 6

Application of Calvary Assembly I of God for a variance from Section 27-768(A) relating to a place of worship within the R-100 (Single Family Residential) District to reduce the required seventy-five (75) foot building setback along any property line to thirty-five (35) feet to allow the construction of an elementary school on site. The project site is located on the north side of Chamblee-Dunwoody Road, approximately 423 feet west of Springfield Drive.

Application of Paragon Development ment Group, LLC for a variance from Section 27-916 of the DeKalb County Zoning Ordinance relating to the R-100 (Single Family Residential) District to reduce the required forty (40) feet setback to twenty (20) feet to allow for construction of twelve (12) single family residences.

Application of H. Leroy Lark for a variance from Section 27-581(C) (1) (a) of the DeKalb County Zoning Ordinance relating to the C-1 (Local Commercial) District to reduce the front yard setback from seventy-five (75) feet to twenty-six (26) fast to construct a 2,250 square foot retail building. The project site is located on the southwest comer of Cedar Street and Ohm Avenue.

13. Commission Districts: 3 & 7

Application of Harold Cunliff for a variance from Section 1440(B)(5) of the Dekalb County Land Development Regulations to increase the floodplain compensation limit from 300 cubic yards per acre to 1,250 cubic yards per acre to allow for a road crossing and compensation for construction of a subdivision. The project site is located on the south side of Henderson Road at Interstate 285.

14. Commission Districts: 2 & 6

Application of Ira L. Tedoff for a Special Exception to Section 27-68(l) of the former DeKalb County Zoning Ordinance relating to the R-75 (Single Family Residential) District to allow a proposed two-lot subdivision to have access to a public street by means of a recorded easement. The project site is located at the northern terminus of Homestead Avenue, approximately 258 feet north of Charline Avenue.
